3. Limitation of Liability
3.1 Reverb Retail Ltd, its directors, officers, employees and representatives, exclude all liability for any loss or damages that may result to you (or a third party) from using this web site, or any link to or from this website, or the inability to use the website.
3.2 Our total liability under contract will be limited to the price paid for the goods, and Reverb Retail will not be liable to you for any indirect or consequential losses.
3.3 Nothing in the above limitation shall exclude Reverb Retail Ltd’s liability for:
3.3.1 Any liability that cannot be excluded by the law governing the contract,
3.3.2 Misrepresentation of a fraudulent nature,
3.3.3 Death or personal injury caused by negligence.
4. Links
4.1 Reverb Retail Ltd does not accept any liability for the content in links to or from our website. As a user of our website, you access them entirely at your own risk.
5. Suitability for purpose and product compatibility
5.1 We exclude any express or implied warranties as to the suitability for a particular purpose of any item, or its compatibility with other products. It is your responsibility to determine suitability of the product purchased, and we will not be held liable for any losses arising.
6. Governing Law
6.1 These terms and conditions will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising.
7. Website availability
7.1 We aim to have our website available for 24 hours per day, but we will accept no liability for any downtime, howsoever caused, and make no guarantees to you of the site’s availability.
8. Purchasing via our website
8.1 The credit cards we accept are shown on the checkout page of our website. These are subject to change without notice.
8.2 When you place an order via our website, we will send you an e-mail confirming receipt of your order. This is only an acknowledgement of your order, and does not mean that any contract between us exists for the supply of the goods and or services requested.
8.3 The goods shown on our website are an invitation to treat, and no contract will exist between us until the goods are physically dispatched to you, or a prepayment is received.
8.4 It is a condition of our contract with you that up until the point of despatch, we may decline to supply the goods ordered at the price stated, and terminate the contract. This is to provide protection to us in the event that the goods are unavailable, or are wrongly priced. In the case of a price change, we will contact you to agree how you would like to proceed.
8.5 We take payment immediately by authorising and settling all credit card transactions as soon as the customer's address has been verified by their issuing bank. If any goods are not available for despatch at the time of the order, the payment taken will be treated as a prepayment. We will contact you to advise you of the estimated time of delivery for goods that are not immediately available.
8.6 If the estimated time of delivery is not acceptable to you, we will cancel your order and refund any amounts paid.
8.7 Where we decline to supply goods ordered, we will make a refund of any payment already made, or offer alternative goods, informing you as soon as possible.
8.8 Where we either decline to supply goods ordered, or become aware that some or all of the goods are unavailable, we will inform you of your options, and if you have not responded within 7 working days, we will deliver those goods that we can and cancel any orders for the unsupplied goods. We will issue a refund for the unsupplied goods.
8.9 Prices shown on our Website may change at any time without notice.
8.10 There will be no delivery until cleared funds are received.
8.11 Ownership of the goods does not pass to you until we have received in full all amounts owed for the goods and any other sums which are due from you to us, on this or other orders outstanding.
8.12 Where we provide a photograph or image of a product, we will try to ensure it is an accurate representation. We cannot, however, be responsible for differences in colour, shape, or size due to photographic processes or display equipment used to view the image.
8.13 We shall not be obliged to perform the contract where performance is prevented by fire, strikes, war, or other events beyond our reasonable control.
8.14 Specification of products is liable to change without notice.
9. Shipping And Handling
9.1 In the case of either large and/or heavy items we reserve the right to charge you amounts for carriage/shipping in addition to amounts already shown at checkout. We will inform you of this before the goods are despatched, and you will have the option to cancel your order if you do not wish to pay the additional carriage charges.
9.2 We reserve the right to charge additional freight/carriage on orders for despatch outside of the UK, but within the EU. We will inform you of this before the goods are despatched, and you will have the option to cancel your order if you do not wish to pay the additional carriage charges.
9.3 Orders for delivery outside the UK and EU will only be accepted by prior arrangement – please call our sales team to discuss before placing your order – additional shipping charges will apply, and you may be liable for duty and VAT/import tax. Reverb Retail Ltd will not in any event be liable for importation charges relating to goods shipped outside of the UK/EU.
9.4 Delivery must be signed for by yourself. Please ensure that you sign for your goods as “uninspected” if you do not have a chance to fully inspect them before accepting delivery.
9.5 Proof of delivery by our carrier is agreed as proof of goods receipt by yourself.
10. Currency of billing and Tax Charges
10.1 We charge VAT at the current rate of 17.5% on all orders. Prices shown on the Reverb Retail Ltd website (excluding sections exclusively for educational customers) are inclusive of VAT. All of our transactions are in UK Pounds Sterling.
10.2 In addition to the price of the goods, you may be required to pay a delivery charge. Delivery charges are separately itemised, and shown when you place an order.
11. Guarantee
11.1 All goods are supplied with a full 12 months manufacturer’s warranty, unless otherwise shown.
12. Cancellation of your contract and returning goods during your “cooling off” period
12.1 Under Distance Selling regulations, you have the right to cancel the contract at any time up to 7 working days from the date we have delivered your order (or received prepayment for goods that are currently unavailable) by giving written notice to us by post, hand delivery or email.
12.2 Notification by phone only is not acceptable.
12.3 Unless the goods are damaged/not working/mis-described:
12.3.1 If you cancel after the goods have been delivered to you, ownership of the goods reverts to us on cancellation, and you will be responsible for returning the goods in “as-new” condition to us at your own cost and risk until booked back into our stock.
12.3.2 The goods must be returned to the address indicated on the shipping documentation and the returns section of the website or as advised by our web sales team.
12.3.3 You must re-pack the goods in their original packaging and ensure that they are adequately protected for their return.
12.3.4 We reserve the right to charge you for damage to packaging and goods returned to us, that was not previously notified to us.
12.4 If the goods are damaged/not working/mis-described:
12.4.1 We will pay for the return carriage of goods that were damaged, not working, or mis-described.
12.4.2 Once you have advised us that you are cancelling your contract, we will refund or credit you as soon as possible, and no later than 30 days from receipt of the returned goods.
12.5 Unless the goods are damaged/not working/mis-described there is no right to cancel a contract for:
12.5.1 Any opened items that may come into contact with your mouth, nose or inner ear, including but not limited to microphones, in-ear earphones, reeds, and mouthpieces.
12.5.2 Items made to a customer’s specific requirements or that require installation.
12.5.3 Software and similar media, which have had the package seal broken.
12.5.4 Hardware where there is associated software which has been licensed/registered/activated with the manufacturer online or otherwise.
13. Privacy Policy
13.1 We will only use the information that we collect about you lawfully and in accordance with the Data Protection Act 1998
13.2 We collect the information you supply to us through web enquiries and orders. We use this information to process your order and prevent fraudulent use of credit and debit cards (including credit checks via a third party). With your consent we will keep you informed of relevant offers and products using this information.
Additionally we collect information about your browsing pattern within our site, that is used in summary form to assist us in improving our web offering. You cannot be personally identified by this information. This data is collected for the exclusive use of Reverb Retail Ltd and is not distributed to other companies for commercial purposes.
13.3 Cookies are used in our web site. Please make sure you have cookies enabled, our checkout facility will not work correctly without it.
13.4 We will not disclose your details to any third parties unless you have agreed that we can, or we are required to do so for legal reasons.
13.5 You will only receive email offers if you have requested that we send them to you, and you can unsubscribe by following the link contained within the emails.
14. Web sales returns policy for faulty products
14.1 All goods are supplied with a full 12 months manufacturer’s warranty, unless otherwise shown – some manufacturers may offer extended guarantees.
14.2 In the event that a product develops a fault, and you have not cancelled the contract under Distance Selling Regulations within 7 days of receipt:
14.2.1 Within 30 days of receipt, we will offer at our discretion: a refund on return of the product OR we will replace the product, OR we will repair the product. We will pay for your return postage costs for faults within 30 days of receipt, but it is your responsibility and risk to ensure that the goods are properly packed in their original packaging and suitably protected for their return journey.
14.2.2 After 30 days following receipt, we will arrange for the product to be repaired. It will be your responsibility, and at your risk, to pay for any postage to either our returns department, or to the manufacturer or manufacturer’s nominated repair agency.
14.2.3 After the product is out of warranty, you should refer to the relevant manufacturer for repair support.
14.3 We will not be liable for any repair/replacement costs arising from the misuse of product(s).
14.4 We will check and/or arrange to have checked any products that are returned to us, by suitably qualified staff. In the event of “no fault found” we will charge you the return carriage for the product, and shall be entitled to hold the product until payment for return carriage has been received.
14.5 The above remedies are for the exclusive benefit of customers who are consumers ie end-user purchasers of goods not for use in their business or trade. Business customers must pursue a remedy under normal business to business trading regulations.

18. Electrical goods recycling at Reverb
Electrical and electronic goods are amongst the world's fastest growing areas of production, fuelled by huge consumer demand and resulting in a growing mountain of waste as old, broken or obsolete electrical goods are thrown away.
The UK Waste Electrical and Electronic Equipment (WEEE) Regulations require that businesses involved in the supply of electrical equipment take an active role in its collection and recycling.
Much of the UK's electronic waste ends up in landfill sites, where toxins put communities at risk. Failure to segregate any type of recyclable material in the home or office will usually result in items being disposed of in a landfill site (buried in the ground in the UK) or being incinerated. Some WEEE can contain hazardous substances, and if this WEEE is put into landfill sites the substances can pollute soil and water supplies. This pollution can have a hazardous effect on human health and the environment.

Products marked with this symbol are classed as WEEE when they are no longer needed and should be disposed of separately to household waste.
Certain products sold by Reverb Retail Ltd fall within WEEE regulations, including for example, electronic musical instruments, amplifiers and sound recording/mixing equipment.
To meet our obligations as a retailer Reverb Retail Ltd has decided not to join the distributor take back scheme (DTS) which would mean you having to take your WEEE to your nearest designated collection facility (DCF). Instead, we offer free Like For Like In Store Take Back for all redundant electrical products. We will then take repsonsibility for the safe recycling of this material. We believe that our customers will find this approach more convenient than visiting their local DCF.
The In Store Take Back Scheme works very simply on a like for like basis. When you are buying, say a new electrice guitar, you can at the same time (or up to 28 days later), if you wish, hand over your old redundant electric guitar as WEEE for us to deal with. The age, make and model of electric guitar you are handing over does not matter. We would not, however, be able to accept,say an amplifier as WEEE if you were purchasing an electrice guitar.
We will then arrange to have your WEEE recycled. If the article is suitable it may be renovated and resold but otherwise it will be sent to an approved and accredited treatment facility where all elements of value will be extracted for further recycling.
You may bring in to Reverb RetailLtd 'Like for Like' WEEE up to 28 days after you make your purchase, but please bring your sales invoice/receipt with you otherwise we will not be able to accept the WEEE.
If you are a mail order customer or purchasing from our website and wish to tkae advantage of this Like For Like In Store Take Back Scheme please bring the item into any of our stores with a copy of your sales receipt/invoice.
Alternatively, you may also send the item you wish to be recycled together with a copy of your sales receipt/invoice for your purchase to: Reverb Retail Ltd 89 Old Snow Hill, Birmingham, B4 6HW, marked 'WEEE take back'. If it is more convenient, you are permitted to take WEEE to your local Designated Collection Facility. Please visit www.recycle-more.co.uk or your Local Authority website to find the location of your local DCF.
